These Terms of Use govern your use of luxedevelopment.net (the “site”), published by Luxe Development, Inc. (“Luxe,” “we,” “us,” “our”) of Lemont, Illinois.

Acceptance of these terms

By using this site or submitting a form on it, you agree to these terms. If you do not agree, please do not use the site.

You must be at least 18 years old to submit a form. The information you give us should be accurate, and the phone number and email address you enter should be your own.

What this website is — and what it is not

This site is marketing information about Luxe Development’s design-build work: what we do, where we work, how the process runs, and examples of finished projects.

It is not any of the following:

• A quote or an offer. Nothing on this site is a price, a bid, or an offer capable of acceptance.
• Professional advice. Nothing here is architectural, engineering, structural, code, permitting, legal, insurance, financial or tax advice for your property. Do not act on it without a professional who has seen your home.
• A commitment to take on your project. We choose the projects we take, and we may decline for any lawful reason.

Service availability, service area, materials, lead times and pricing all change. We may add, change or remove anything on this site at any time, without notice.

Your project is governed by your signed agreement

This is the most important line on this page.

If you become a Luxe client, your project is governed entirely by the written proposal and agreement you sign — the scope, the drawings, the allowances, the schedule, the price, the payment terms and the warranty all live there.

These Terms of Use govern the website. They do not create, replace, modify or interpret any construction agreement, and nothing on this site becomes part of your contract. Where anything on this site differs from your signed agreement, your signed agreement controls.

Submitting a form starts a conversation

Our forms exist to start a conversation about your project. Sending one is a request for a consultation, nothing more.

• Submitting a form creates no obligation on either side. You are not agreeing to hire us, to pay anything, or to move forward. We are not agreeing to take the project, to hold a price, or to a schedule.
• A response from us — by phone, email, text or in person — is a conversation, not an acceptance. Neither side is committed until a written agreement is signed by both.
• We aim to reply within one business day. That is how we work, not a guarantee, and we cannot promise that every submission reaches us. If a request is time-sensitive, call (312) 445-0727.
• Please do not send sensitive information through our forms — no financial account numbers, government identification, or health information. Web forms and email are not secure channels.

What we collect when you use the site and submit a form, and where it goes, is set out in our Privacy Policy.

Estimates, ranges and cost guidance

Some pages on this site publish typical cost ranges — for example our kitchen and bathroom cost guides — and our forms ask about your investment range so we can be straight with you early.

All of it is illustrative. Those figures reflect past work and market conditions at the time of writing. They are not a quote for your home, and they do not account for your existing structure, your selections, site conditions, permitting, or what materials and labor cost on the day we price it.

Published ranges can go out of date, and we are not obligated to honor a figure shown on this site. The same is true of any number mentioned in a phone call, an email, a text, or during a walkthrough of your space.

Only a written proposal signed by both parties sets scope and price.

Photography and portfolio content

Our project pages show Luxe Development’s own completed work, photographed on site. Where an image elsewhere on the site is a representative example rather than a specific completed project, it is labeled as such on the page it appears on.

Finished results vary. Every home, site, budget and set of selections is different, and a project shown here is not a promise of the same outcome on your property.

All photography, drawings, plans, renderings and project descriptions on this site are owned by Luxe Development, Inc. or used with permission. They remain our property. They may not be copied, republished, resold, or used to promote another business.

Intellectual property and permitted use

The site and everything in it — text, photography, layout, design, code — along with the Luxe Development name and logo, are the property of Luxe Development, Inc. or its licensors, and are protected by United States copyright and trademark law.

You may:

• View and browse the site.
• Print or save pages for your own personal, non-commercial use while you are considering working with us.
• Share links to any page.

You may not, without our written permission:

• Copy, republish, sell, license or distribute any content from this site.
• Use our photography, copy or project descriptions in your own marketing, or in another builder’s.
• Use the Luxe Development name, logo or brand in a way that suggests affiliation, endorsement or partnership that does not exist.
• Remove or alter any copyright, trademark or credit notice.
• Frame, mirror or present the site as your own.

Acceptable use

When you use this site, you agree not to:

• Attempt to gain unauthorized access to the site, its hosting, or any connected system.
• Interfere with the site or overload it, including through automated requests.
• Scrape or harvest content, images or contact information by automated means.
• Circumvent or interfere with our bot protection.
• Submit false information, or someone else’s contact details without their permission.
• Use our forms or phone number for solicitation, spam or any unlawful purpose.
• Upload or transmit malicious code.

We may block access to the site, or decline to respond to a submission, at our discretion.

Third-party links and embedded content

This site links to third-party pages, including our Google Business Profile and our social profiles. We do not control those sites and are not responsible for their content, accuracy or practices. Their own terms and privacy policies apply once you leave ours.

The footer of every page on this site embeds a Google Map. When a page loads, that embed loads content directly from Google, and Google receives information about the request. That happens on page load, whether or not you interact with the map. Your use of the map is subject to Google’s own terms, and we explain what is transmitted in our Privacy Policy.

Bot protection, analytics and your privacy

Two things run on this site that you should know about:

• Bot protection. Our forms are protected by Cloudflare Turnstile, which checks that a submission is coming from a person rather than an automated script. Completing that check is a condition of submitting a form.
• Analytics and advertising measurement. We use Google Analytics and Google Ads conversion measurement to understand how the site is used and which advertising produces enquiries. These set cookies when a page loads.

What is collected, what is shared, and with whom, is described in full in our Privacy Policy, which forms part of these terms. You can control cookies through your browser settings; our forms will still work if you do.

The site is provided as is

We work to keep this site accurate and current, but we do not warrant that it is. Content can be incomplete, out of date, or contain errors, and the site may be unavailable or interrupted at times.

To the fullest extent permitted by law, the site is provided “as is” and “as available,” and we disclaim all implied warranties in connection with it, including merchantability, fitness for a particular purpose and non-infringement.

To be clear about what this covers: this disclaimer is about the website. It does not affect any warranty, obligation or right under a signed Luxe Development agreement, and it does not limit any right you have that cannot be waived under Illinois law.

Limitation of liability

To the fullest extent permitted by law, Luxe Development, Inc. is not liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, lost data or lost opportunity, arising out of or connected to your use of this site or your reliance on anything published on it.

Again, this section concerns the website. It does not limit our obligations under a signed agreement with a client, and it does not limit any liability that cannot be limited under applicable law.

Indemnity

If you use this site in a way that breaks these terms or the law, and that conduct causes a claim against us, you agree to cover the reasonable costs we incur defending it, including reasonable attorneys’ fees.

This applies only to claims caused by your own conduct. It does not apply to anything we did. We will tell you promptly about any claim we intend to seek costs for, and you may take part in the defense.

Governing law and venue

These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any dispute about this site or these terms will be brought in the the state and federal courts of Cook County, Illinois, and you consent to that venue.

If any part of these terms is found unenforceable, the rest stays in force.

Changes to these terms

We may update these terms. When we do, we post the revised version on this page and change the effective date at the top. We do not notify visitors individually.

Continuing to use the site after a change means you accept the updated terms. The version in force is the one posted here.
